$NLST Something else with the EagleView example cited by Netlist in their motion that wasn't mentioned—while I was looking into other non-cited examples that support—among other similarities is that during the EagleView CAFC appeal there was a parallel stayed case with a non-related third party pending the patent's validity outcome...just like with Google & 912! 🎯 "When EagleView and Nearmap settled their litigation, there was actually a parallel, stayed patent-infringement lawsuit in the exact same district court (EagleView v. GAF) involving a subset of the same patents. Despite GAF being a completely non-related third party whose case was stayed pending the validity outcome, the USPTO Director moved forward with the remand and vacated the Board's invalidity decision." "Yes, the USPTO Director absolutely can—and historically does—still step in to vacate an unpatentability ruling, even if a live controversy exists with a separate, non-settling party in a stayed district court case."

$NLST Let’s see,Chuck battled through the years with hardly any cash except for dilution to survive ,and he won license agreements against some of the biggest companies in the world, with a SKhynix renewal coming soon! The biggest factor is he didn’t go bankrupt through all the litigation!Chuck has a war chest to work with now with all the royalty revenue and the upfront 200 million cash Samsung paid,to work with!If a guy can achieve so much with hardly any cash except for having to dilute his company (that he was forced to do or go bankrupt)what do you think he can accomplish with the war chest that is building as we speak?I think we have just scratched the surface of things that will happen in the coming days ,weeks ,months and years,as we are seeing new things already happening that were unexpected and many more are coming (IMO.)The future is finally bright for Nlst longs that have stuck it out for many years!GLLs

$NLST I will add...my strong belief is that USPTO Dir Squires is certainly going to get involved through at least intervention if not with a motion to vacate and remand first...there is no way the 912 appeal will be allowed to be rendered moot and dismissed. 👁🍿👁 Squires is well aware of Netlist's 912 ptnt litigation, and specially given a live controversy still exists with Google, Squires will make sure it plays out to conclusion either on the validity front at CAFC/USPTO or on infringement in District Court—should CAFC remand and he reverses the PTAB invalidity decision—without letting it all end unresolved now after the unjust and lengthy 912 validity campaign. 🧠⚖️🫀

$NLST Fyi...Netlist is very familiar with Kingston who were indirectly part of Netlist cases against Samsung & Micron in District Court and in ITC investigations. They were subpoenaed by Netlist during third party discovery and complied by providing information...the name sounded familiar so I did a basic search with showed enough, not going to dig into the cases to pull all the docs. "While they managed to avoid being a named defendant for years, Netlist aggressively targeted them using third-party discovery subpoenas during its high-profile lawsuits against major DRAM manufacturers and system builders (such as Samsung, Micron, Google, and Supermicro)" "Because Kingston spent years as a prominent non-party supplier trapped in the middle of Netlist’s litigation, it had to participate heavily behind the scenes. The extensive record of high-profile cases where Kingston Technology participated spans third-party discovery, subpoenas, material evidence tracking, and finally, direct litigation"

$NLST Thinking out loud: considering the many similarities between the Eagle View case and Netlist’s ’912 case — and the fact that Squires’ final Eagle View decision came only on September 23 — I wonder whether Netlist intentionally compromised on the Micron settlement, giving up some potential upside in exchange for settling as quickly as possible in order to: * get Micron to withdraw from the ’912 appeal; * prompt the CAFC to ask the USPTO whether it wants to intervene; and * keep the gap from the Eagle View outcome as short as possible, so that the Eagle View reasoning would still be very fresh when the CAFC put the question to the USPTO. Maybe coincidence — but the timing is certainly interesting.

$NLST brief summary of my AI tool on the new Kingston case. I did NOT cross check at this stage, because I can live - at present - with that uncertainty. We will soon know more about. 1. Kingston was the world’s #1 third-party DRAM-module supplier in 2025 with about 62% of revenue share, in a market TrendForce estimated at $21.2B. verified: https://www.businesswire.com/news/home/20260928581215/en/Kingston-Retains-No.-1-Position-in-Global-DRAM-Module-Market 2. NLST does does not stop after S, MU, SKH, G, but goes from memory to module producer! Some Netlist’s patents cover the architecture and operation of the memory module, not simply the DRAM die itself or limited to them. Kingston material has actually appeared in prior Netlist/Samsung PTAB proceedings as technical evidence. For example, Samsung’s PTAB record contains a Kingston memory-module specification as an exhibit.

$NLST Looks like Sheasby filed a new lawsuit in the California Central District Court yesterday. Looking forward to seeing the details on this. Samsung, SK Hynix and Micron manufacture the memory dies and chips that Kingston purchases. If the finished module practices a patented invention, Kingston could potentially be liable for importing, offering to sell or selling that product in the United States, even if another company manufactured the underlying DRAM chips.

$NLST the first company to sign a licensing agreement WITHOUT a lawsuit will also be a big milestone. Who knows how many parties we are in discussions with now…

$NLST I always hate to get ahead of ourselves. Let’s just take a deep breath and let things play out. Having said that, I do have to say I feel that everything has changed regarding Netlist. I feel now it feels like everyone feels the right side is to be aligned with netlist. The courts, the Ptab now they all can join the club and be correct and stand up for what’s right. It’s now netlist, Samsung, micron all together and rich google as the only thief left that needs to just write a check. It seems like it only a given that that’s gonna happen. SK Hynix is a given and just a negotiation. They were a partner before and certainly will sign a fair deal.

$NLST There are at least a dozen other major companies that could theoretically become Netlist’s next target. Happy weekend 🍀🙏

$NLST Following the Samsung ($897M) and Micron ($600M) settlements, Netlist is well-positioned to target independent US-based memory module makers that assemble unlicensed components downstream. Because companies like Kingston Technology face direct legal pressure for using unshielded patent architectures, four similar US assemblers carry identical infringement vulnerabilities: • Corsair Gaming: Uses third-party DRAM for its performance Vengeance and Dominator lines. • PNY Technologies: Assembles retail and corporate upgrade memory kits and flash storage. • Patriot Memory: Manufactures gaming-tier Viper RAM configurations. • SMART Modular Technologies: Engineers high-density, server-grade custom memory sub-assemblies for enterprise data centers. Backed by its massive new legal war chest, Netlist can systematically pursue these assemblers to enforce industry-wide licensing compliance. Huge profit coming in..In ..IN...What a great investment I made..NLST!!

$NLST Kingston Technology is one of the world’s largest independent makers of memory modules (DRAM), SSDs and flash storage. It’s privately held and based in Fountain Valley, California, and was founded in 1987 by John Tu and David Sun... Nature of suit 830 and the cite to 35 U.S.C. § 271 = this is a patent infringement suit, i.e. an allegation that Kingston makes or sells products using NLST’s patented technology without a license, likely to obtain a license or damages... :-)

$NLST patent licencees of Rambus (from 10-K, 2025) names 23 patent licensees (not necessarily comprehensive) and include: CXMT With royalties alone from the big 3 (S, MU, SKH) alone Netlist should have very similar royalties revenue as Rambus, and with the $ 1.5 bio product supply, NLST could have additional $ 300 Mio product revenue again, similar/close to Rambus. And this considers currently only S, MU and SKH. Omce we have 20 or more royalty paying costumers…. appears as if CXMT pays royalties without having been sued by Rambus. Of course it will not come over night to get a similar PER as Rambus, but even it gradually aligns over a certain period of time… https://www.sec.gov/Archives/edgar/data/917273/000119312526057101/rmbs-20251231.htm?utm

$NLST I remember months ago when everyone was saying that Netlist can't settle with Micron before the CAFC decides on the 912 or else the patent will remain invalid for good, Stokd kept preaching that the USPTO director will intervene one way or another. That's what's happening as we uncover more, and all I know is to trust our contributors and the process, good things are coming.

Hong must be feeling pretty confident with where Google and SK sit to open up a new suit while those are still going on in the background… unless maybe he isn’t so worried about those two anymore? Sheasby is still in control and steering the ship on these legal proceedings so whatever direction they go we can trust the still undefeated Sheezzz is guiding us well! $NLST

$NLST Now, with over $200 million in NET annual profits, Netlist will finally be able to hire a large number of engineers—hopefully opening a new facility in Texas while keeping the one in California operational—which will allow them to launch 5 to 10 new products and create fresh opportunities. If you have access to $600–$700 million worth of memory—from Samsung and SK Hynix—it means you can transform that volume of memory into your own proprietary products and show huge amount of new profits

$NLST man I’m excited about Monday. Hope I can get my new shares for under $6. When I decide I want more I just buy and I don’t worry about nickels and dimes. If you believe this is gonna double, triple or more just lock yourself into as many as you can. Don’t miss the big jump of dollars when the next big one hits.
